研究生阶段知识产权法的学习与本科生阶段的学习要求不同，应着重以国内外知识产权领域中出现的重点、热点问题作为研讨对象，而不宜重走从法律关系到法律体系的老路。因此，本课程在教学中融讲课、专题辩论、文献阅读、学术研讨、论文写作等方法于一体。在教学内容方面着重介绍知识产权理论的核心原则（即知识产权权利人利益与公众利益平衡的原则）；知识产权法律的实施原则（即尊重并合理保护知识产权的原则）；知识产权制度的实施目标（即有利于科技知识的扩散和传播、有利于人类共享科技进步带来的利益）；基于中国国情整合知识产权与发展政策的理论与实践；版权和专利若干基本概念的争议与辨析；高新技术知识产权实践中的热点问题，包括软件最终用户使用未经授权软件的法律责任问题，著作权人采用技术保护措施的合理界线问题，信息网络传播权的理论与实践问题，网络域名相关的知识产权问题，网络游戏中虚拟物、外挂软件、未经授权提供游戏服务相关的知识产权问题，高新技术企业的知识产权战略问题等。

Master degree students, which different from undergraduate students, should pay more attention to the weight-bearing points and hot-discussed issues in the field of the intellectual property law instead of always analysis issues in the fixed way of legal relationship and legal system. For such reason, this course uses kinds of method in the teaching process, such as lectures, issues debating, material reading, seminar and essay writing. This course emphasizes more on the basic theories in the intellectual property law field. The first is the core principle of the intellectual property law, which is interests balance between the right-holders and the public. The second is the principle of intellectual property law enforcement, which is to esteem and reasonable protect intellectual property. The third is the aim of intellectual property system which is to benefit the spread and development of the technology and to benefit the people in sharing the new technique. The fourth is intellectual property develop policy based on Chinese national conditions. This course also introduces and compares basic confusing conceptions in copyright law and patent law. What’s more, this course includes some hot-discussed issues related to the last developed technology, such as the responsibility of the end-users using unauthorized software, the reasonable limitation for the authors using technological measures, theories and the practical problem of the propagating right in cyberspace, issues related to the domain name, intellectual property problem of virtual property, plug-in software in online games and providing online game service without authorize.
